Refusing to Sell Alcohol

You can refuse to serve or sell alcohol to anyone who fails to show proper identification of age, reasonably appears to be a minor, or to prevent someone from becoming visibly intoxicated.

You may retain identification cards for a reasonable amount of time to determine the age of the person. You must inform the person why you are retaining the card.

In order to prosecute an individual for using a false or altered identification card or a card belonging to another person, the following information is needed:

  • Name and address of business where card was retained
  • Reason the card was retained
  • Date and time the card was retained
  • Did the card belong to the person presenting it
  • Name and address of employee that retained the card
  • Any statements made by the holder of the card
  • Any other information you feel is important

Under the Maine Liquor Liability Act, anyone who negligently or recklessly serves a minor or visibly intoxicated person liquor is liable for any damages proximately caused by that person’s consumption of liquor. (Title 28-A section 2501)
